Getting a Divorce

A Court may order a Divorce on any of the following three grounds: (a) spouses have lived separate and apart for one year; (b) adultery; or (c) cruelty.  Where all other issues are resolved or parties are seeking a divorce and not addressing any other issue, neither spouse is required to attend Court in person.  A “simple divorce” is obtained through commencement of an application for Divorce and the filing of an Affidavit.

Common Law Separation

Common-law Separation

There are a number of issues to be resolved when spouses separate who are not married including (a) property; (b) custody/access; and (c) support.  The difference, however, between married and common-law partners are significant with respect to their property entitlements.  Morrison Williams may assist common-law spouses in understanding their rights, obligations and entitlements upon separation and resolving such issues.

Upon separation, married spouses and common-law partners must address the property issues arising from the breakdown of their relationship.  While married spouses are entitled to an equalization payment, common-law partners must rely on equitable/trust claims if they are not the registered owners of property.  Property is not limited to real estate but also includes bank accounts, pensions, and other significant assets.

Child Support

Supporting a Child after Divorce

Every parent has an obligation to support his or her child.  In Ontario, child support is determined in accordance with the Child Support Guidelines.  The amount of support payable depends on (a) the number of children; (b) the payor’s income; and (c) the parenting schedule.  Parents may also be responsible to contribute towards a child’s special and/or extraordinary expenses, such as daycare, school, sports, and dance.

Spousal Support

Giving Spousal Support

Married and common law partners may have an obligation to pay support to their spouse upon separation.  A two-step analysis determines whether spousal support is payable: (1) entitlement; and (2) quantum and duration.  A spouse may be entitled to support based on the roles assumed during the relationship or their need for support.  The quantum and duration of support will be considered only if entitlement is established.
